Brian P. Kelley, MD, operates The Income Variable (“The Income Variable,” “we,” “us,” or “our”). This Privacy Policy explains how information is collected, used, disclosed, and protected when you visit theincomevariable.com or related pages operated by us (the “Site”), join an email list, or use a companion calculator, map, or other interactive tool.

By using the Site, you acknowledge the practices described in this Privacy Policy. If you do not agree with these practices, please do not submit personal information through the Site.

1. Information We Collect

Information you provide

We may collect information that you choose to provide, including:

  • your email address;
  • your name, if a form requests it;
  • your email-list preferences and consent choices;
  • messages or other information you send to us; and
  • information you voluntarily enter into a form or interactive feature.

Please do not submit medical records, protected health information, patient information, or other sensitive clinical information through this Site. The Site is not a patient portal and is not intended to receive information for diagnosis, treatment, or clinical communication.

Information collected automatically

When you visit the Site, Webflow and other infrastructure or security providers may automatically receive technical information such as:

  • Internet Protocol address;
  • browser and device type;
  • operating system;
  • referring and visited pages;
  • approximate location derived from an IP address;
  • access dates and times; and
  • diagnostic, security, and performance information.

This information is generally used to deliver the Site, prevent abuse, troubleshoot problems, and understand aggregate usage.

Companion-tool information

The Site may offer calculators, maps, questionnaires, and other interactive tools. Unless a tool clearly states otherwise, we do not intentionally associate the values entered into these tools with your identity. Some tool interactions or values may nevertheless be processed by your browser, included in a page request, or appear in technical logs maintained by our hosting and security providers.

Do not enter account numbers, Social Security numbers, medical information, or other sensitive personal information into a companion tool.

2. How We Use Information

We may use information to:

  • operate, maintain, secure, and improve the Site;
  • provide access to requested maps, calculators, downloads, or other resources;
  • manage email subscriptions and waitlists;
  • send book updates, articles, companion-tool announcements, and related communications you requested;
  • respond to questions or requests;
  • measure aggregate Site performance and usage;
  • detect spam, fraud, abuse, or technical problems;
  • enforce our terms and protect our rights; and
  • comply with applicable law.

We do not use information submitted through this Site to provide individualized medical, financial, investment, tax, legal, or insurance advice.

3. Email Communications

Email-list and waitlist registrations are processed through EmailOctopus. If you subscribe, EmailOctopus may process your email address, subscription status, consent information, and engagement information on our behalf.

You may unsubscribe from marketing emails at any time by using the unsubscribe link in an email. We may still send a limited nonmarketing message when reasonably necessary to respond to a request or administer a transaction you initiated.

4. Cookies and Similar Technologies

Webflow, EmailOctopus, Google reCAPTCHA, Cloudflare, and other service providers may use cookies, local storage, pixels, scripts, or similar technologies that are necessary to provide forms, prevent automated abuse, secure the Site, and maintain performance.

We do not currently use advertising pixels to build profiles for targeted advertising, and we do not sell personal data for targeted advertising. If we later add nonessential analytics or advertising technologies, we will update this Privacy Policy and provide any notice or choices required by applicable law.

You can control many cookies through your browser settings. Disabling necessary technologies may prevent forms or other Site features from working properly.

5. How We Disclose Information

We may disclose information to:

  • Webflow, which hosts and delivers the Site;
  • EmailOctopus, which processes subscriptions and email communications;
  • Google reCAPTCHA and security providers, which help detect automated or abusive activity;
  • other vendors that provide hosting, technical support, email delivery, security, or similar services;
  • professional advisers when reasonably necessary for legal, accounting, security, or compliance purposes;
  • government authorities or other parties when required by law or reasonably necessary to protect rights, safety, or security; and
  • a successor or potential successor in connection with a merger, sale, reorganization, or transfer of the Site or its assets.

These providers may process information under their own terms and privacy policies. We do not control the privacy practices of third-party websites or services.

6. Sale of Personal Data and Targeted Advertising

We do not sell personal data for money. We also do not currently process personal data for targeted advertising or profiling that produces legal or similarly significant effects.

If these practices change, we will update this Privacy Policy and provide any legally required notice and opt-out mechanism. Because we do not currently engage in these activities, browser-based opt-out signals do not change our present practices.

7. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including to maintain an active subscription, respond to a request, comply with legal obligations, resolve disputes, and protect the Site.

Email-subscription information may be retained until you unsubscribe or request deletion, subject to limited suppression records maintained to ensure that an unsubscribe request continues to be honored. Technical logs may be retained according to the practices of our hosting and security providers.

8. Data Security

We use reasonable administrative and technical measures intended to protect personal information. However, no website, transmission method, or storage system can be guaranteed to be completely secure. You submit information through the Site at your own risk.

9. Your Privacy Rights

Depending on your residence and applicable law, you may have the right to request that we:

  • confirm whether we process your personal data;
  • provide access to personal data associated with you;
  • correct inaccurate personal data;
  • delete personal data;
  • provide a portable copy of personal data you previously provided; or
  • honor an applicable opt-out right.

To submit a request, email hello@theincomevariable.com with the subject line Privacy Request and describe the request. We may need to verify your identity before completing it. We will not discriminate against you for exercising an applicable privacy right.

If we deny a privacy request, you may appeal by emailing hello@theincomevariable.com with the subject line Privacy Appeal and explaining why you believe the decision should be reconsidered. We will respond within the period required by applicable law.

You may also unsubscribe from marketing emails at any time through the link contained in each message.

10. Children’s Privacy

The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has submitted personal information to us, contact us so that we can evaluate and, where appropriate, delete it.

11. Third-Party Links

The Site may link to websites, publications, products, or services operated by third parties. Their privacy practices are governed by their own policies. A link does not mean that we control or accept responsibility for the third party’s privacy or security practices.

12. Visitors Outside the United States

The Site is operated from the United States and is primarily intended for a United States audience. If you access the Site from another country, information may be transferred to and processed in the United States or other locations where our service providers operate. Those locations may have different data-protection laws than your jurisdiction.

13. Changes to This Privacy Policy

We may update this Privacy Policy as the Site, its tools, or applicable law changes. The revised version will be posted on this page with an updated effective date. Material changes may also be communicated through the Site or by email when appropriate.
